Terms and conditions for using the My web app
By accessing My web app, hereinafter referred to as “the site,” you agree to be legally bound by the general terms and conditions outlined below. If you do not accept these terms and conditions, you are not authorized to use the site’s services for any purpose whatsoever.
You understand that you have no right to the site’s on-line services, other than the rights of use specifically granted under this user agreement.
This user agreement may be modified from time to time, in whole or in part. Any upcoming change will be clearly indicated on My web app. Your acceptance of the change by clicking on the “Accept” button, and your subsequent use of the site’s services shall be construed as your acceptance of these changes.
Should you not accept the changes or be dissatisfied with any policy or decision made when using the services, your only recourse is to terminate the user agreement by giving written notice by e-mail and terminating your use of these services, without reimbursement of any kind nor liability of the Ville de Sherbrooke or Locomotive Inc. toward anyone.

1. General description of My web app
1.1. My web app enables registered users to receive information via e-mail, or text message,(depending on the options available) on municipal topics within categories the user will have chosen beforehand.
1.3. This site is controlled and administered by the Ville de Sherbrooke and serves solely as a means for the Ville de Sherbrooke to issue messages of public interest from the city.
1.4. At no time shall the Ville de Sherbrooke use this service to send users information of a commercial, advertising, religious, or political nature; information for solicitation purposes; or information in the form of propaganda.
2. Intellectual property
2.1. The intellectual property of My web app, including its contents (logos, texts, information, images, software, etc.), belongs to the Ville de Sherbrooke and its supplier, Locomotive Inc. Users are prohibited from reproducing, modifying, forwarding, publishing, etc., and from creating works derived from the aforementioned elements.
2.2. Users are prohibited from modifying, reproducing, forwarding, or publishing any information, logo, text, image, software, or other contents belonging to Ville de Sherbrooke or Locomotive Inc. obtained from the site, and from creating works derived from the aforementioned elements.
3. User responsibilities
3.1. The user agrees to keep their personal information up to date.
3.2. The user understands and accepts that the contents of the messages sent by My web app do not replace the regulations in effect, and that in the event of any discrepancy with municipal by-laws, the latter shall prevail.
3.3. Locomotive Inc. and the Ville de Sherbrooke assume no liability or responsibility for any towing, penalty, fine, or any other monetary loss experienced by a user resulting from contact information that has not been updated and the impossibility of sending them timely warnings.
3.4. The user understands and accepts the fact that the Ville de Sherbrooke cannot guarantee the accuracy of the information issued by Mon Sherbrooke and that, consequently, the Ville de Sherbrooke assumes no liability or responsibility for any inconvenience or damage caused by erroneous information, an inability to reach the user (contact information not updated, electronic issues, power failures, breakages, etc.), or non-use of the site to communicate any given information.
3.5. The user commits to keep their password confidential and is responsible for any activity conducted through their account.
3.6. The user commits to not use My web app for illegal purposes such as:
knowingly forwarding viruses or other destructive components;mass-mailing unsolicited e-mails (SPAM);attempting to breach the implemented systems on the website or to make the site unusable;accessing the accounts of other website clients or collecting personal information on them;sending messages with illegal, defamatory, offensive, obscene, harassing, or hateful content.3.7. Any user using the site illegally is subject to sanctions, prosecution, and other procedures provided for by law.
3.8. The Ville de Sherbrooke and Locomotive Inc. reserve the right to terminate a user's subscription to My web app at any time or to restrict access if the user is or appears to be using it inappropriately, or for any other reasonable grounds.
3.9. Locomotive Inc. may, at its absolute discretion, and at any time, terminate the user's subscription or restrict their access to its website if it suspects or observes an inappropriate use of the site’s services or any other reason that Locomotive Inc., as operator, deems appropriate. Should the case arise, Locomotive Inc. shall not be responsible for any damage or loss involving the user or a third party if Locomotive Inc. decides to revoke, cancel, or terminate the user's subscription, or to limit their access to the site.
4. Responsibilities of the Ville de Sherbrooke and Locomotive Inc.
4.2. The Ville de Sherbrooke shall not send any messages of a commercial, advertising, religious, or political nature; messages for solicitation purposes; or messages for purposes of propaganda.
4.3. The Ville de Sherbrooke shall use reasonable means to send accurate information via its site. Nonetheless, the Ville de Sherbrooke cannot guarantee the accuracy of the information sent, and the user acknowledges this and agrees to use the site “at their own risk.” It is therefore the user’s responsibility to assess the usefulness and the reliability of the contents of the messages issued by the Ville de Sherbrooke.
4.4. The Ville de Sherbrooke reserves the right to alter or to discontinue, in whole or in part, on a temporary or permanent basis, any service offered on the site, at any time and at its sole discretion.
5.1. The user accepts to hold harmless the Ville de Sherbrooke, including its administrators and employees, and Locomotive Inc., including its employees and affiliated companies, from and against any suit, claim, or other procedure resulting from use of this site.
6. Guarantee disclaimers
6.1. The user agrees to use the site at their own risk, and accepts that the site’s services are provided “as is” and “according to their availability.” Consequently, the Ville de Sherbrooke and Locomotive Inc. provide no guarantee pertaining to the contents and services of My web app.
6.2. The Ville de Sherbrooke, including its administrators and employees, and Locomotive Inc., including its employees and affiliated companies, shall not be liable for any damage or other impairment resulting from use of the site or the impossibility to use it.
The Ville de Sherbrooke is committed to protecting the privacy of users visiting its website. The information provided shall be protected under the Act Respecting Access to Documents Held by Public Bodies and the Protection of Personal Information (CQLR c A-2.1). This law obliges the Ville de Sherbrooke to ensure the privacy of personal information obtained in a written, graphic, sound, visual, computerized, or other manner. The Ville de Sherbrooke must therefore, with no exception, obtain the consent of the person involved before it can share personal information.
